CONDITIONS IN BRIEF :
- Chalet rental from 2 nights: arrival and departure day free (contact us for single-night bookings and groups).
- Payment must be made on booking by credit card, ANCV-connect or bank transfer (bank cheques are no longer accepted). No option will be taken into account without payment;
- Prices include taxes, utilities, linen and final cleaning. Reduced price for 4 nights or more
- Dogs allowed in certain chalets (stay to be declared when booking, additional costs). Cats and other animals not permitted.

GENERAL RENTAL CONDITIONS – COMPLETE
Art.1. Purpose : Seasonal rental contract drawn up between a tenant and the owner of the residence. In accordance with the French Tourism Code (art. L324-2), the description and price of the rental are communicated to the tenant. Only the information published on the website (except for errors in online pricing) and the booking form issued by the owner will be considered valid. Information published on other websites and networks, as well as photographs, are indicative only. The general terms and conditions of rental (hereinafter referred to as “GTC”) apply to all rentals, regardless of how the reservation is made.
Art.2. Tenant The “hirer” is the person who takes out the contract. The tenant is required to provide full contact details and the names of any accompanying persons for whom he/she assumes de facto responsibility. The owner undertakes not to divulge to any third party any information provided by the lessee in connection with this contract, with the exception of requests for information made by the authorities and/or the courts.
Art.3. Conclusion of contract : The reservation becomes effective when the tenant has paid the total amount of the stay after receiving the information and the invitation to pay. Payment therefore constitutes a contract and unreserved acceptance of the CGL as well as the complementary internal regulations (available on the website). In the absence of payment (unless specifically mentioned in the contract), the property remains available and the tenant cannot take advantage of the rental, which may therefore be cancelled and benefit a third party. In all cases, and as a matter of fair play, the tenant is required to inform the owner immediately if he/she wishes not to proceed or to cancel the booking request; otherwise, the owner is entitled to refuse the tenant for a subsequent stay.
Art 3.1. Contract duration and arrival and departure times : The lessee has entered into a contract for a fixed period; under no circumstances may he/she claim any right to remain in the premises after the expiry of the rental period initially stipulated in the contract, except with the written agreement of the owner and in advance payment of the amount of the authorized extension.
The tenant is expected on the first day of his stay between 4.00 pm and 6.00 pm / 7.00 pm (depending on the season) and leaves the residence on the last day of his stay by 10.00 am at the latest (12.00 pm for a one-night stay). Any delay in departure may be subject to a supplement of up to one additional night, unless otherwise agreed.
Art.4. Use of the premises : The owner will provide the premises or residence in accordance with the description, clean and in perfect working order. He will not undertake any work that is not of a manifestly urgent nature, except for the necessary seasonal maintenance of the surroundings.
- Art. 4.1. The tenant will enjoy the property in a peaceful manner and will make good use of it, in accordance with the purpose of the premises. The tenant has noted that smoking is strictly forbidden on the premises.
- Art..4.2. The installation of tents or the parking of caravans, motor homes or cars on the grounds of the rented property is prohibited.
- Art. 4.3. On departure, the tenant undertakes to leave the residence and its surroundings in a clean and tidy condition (bed linen removed, crockery done and put away, parasol folded, dog faeces removed, garbage sorted and disposed of in the appropriate containers, etc.). All equipment listed in the inventory must be returned in its entirety and in the same place it occupied when you entered the premises. Any replacement, cleaning, tidying up or repairs, however extensive, made necessary by the tenant’s negligence, will be at the tenant’s expense.
Art.5. Terms of payment : all payments are made online on receipt of the contract. After a maximum of 24 hours, the stay may be transferred to a third party. In all cases, full payment must be made before you move in and will not be reimbursed by the owner (see insurance reimbursements).
- Art.5.1. Payment methods. Payment is preferably made via the online payment platform (by credit card), otherwise by bank transfer (tenant’s name, name of residence and date of stay must be mentioned in the subject line).
- Art. 5.2. ANCV vacation vouchers (ANCV-Connect) are accepted for individual stays (not for group stays); they must be sent by registered post with acknowledgement of receipt, and must clearly mention “Hector SAS” as the beneficiary. Less than 5 days before the start of your stay, ANCV vouchers and cash payments are accepted on arrival, subject to an online deposit at least equal to the price of the deposit and the stay.
Art.6. Tariff : Prices include VAT, compulsory services (linen and final cleaning) and all charges (water, electricity, pellets, wood, internet) within the limit of normal use (8 KW/day/person and no overrun of the internet package). Prices are available online and on request.
- Art.6.1. Energy consumption: The tenant is obliged to take care not to waste energy (heating reduced and lights off in his absence, windows and shutters closed in case of cold, etc.). For longer stays, meters are read at the beginning and end of the stay, and the actual consumption is settled on departure. The price announced at the time of booking is firm and definitive, and may not be modified, either upwards or downwards, regardless of changes in the price scale (except in the case of postponement, when the higher price will be applied). Cleaning and bed linen are compulsory extras to ensure the good maintenance of the residences.
- Art.6.2. The amount of the taxe de séjour (paid in full to the Communauté des Communes des Sommets et Grands Lacs du Morvan) is governed by regulations and may be modified by the administration. It applies to all adults (+18 years) and is calculated per night. It is paid at the time of booking, on arrival or at the latest on the day of departure. For ease of management and transparency, it is offered for payment at the time of booking. The owner cannot be held responsible for the amount of taxes levied by the OTAs (Airbnb, Abritel, etc.) and will not make any reimbursement in the event of a difference compared to the actual statutory rate.
- Art. 6.3. Benefits or discounts may be granted at the discretion of the host; in principle, they cannot be accumulated. The most advantageous discount applies. They must have been notified when the contract was issued and are not refundable at a later date.
- Art. 6.4. Additional fees may be charged for any additional administrative work outside the management of a contract (e.g. additional services requested, multiple payments and/or invoices for a group booking, estimates and files prepared and not validated, options taken after the stay has been validated, reimbursement files from vacation funds or works councils, etc.).
- Art. 6.5. For longer stays (14 days or more), an intermediate cleaning and change of linen is provided and charged to the tenant. The tenant may not refuse the weekly visit of the housekeeper. The housekeeper will ensure that the residence is kept in good condition, failing which the stay may be cut short or the deposit immediately forfeited.
Art.7. Participants : The present contract is established for a specific accommodation of a certain capacity.
- Art. 7.1. The number of participants may not exceed the maximum capacity indicated on the description of the residence. In exceptional cases, if this rule is not respected with the written agreement of the owner or his representative, the latter is entitled to increase the price or to change the tenant of the chalet with a supplement.
- Art. 7.2. The tenant must provide a list of participants (name, e-mail address and telephone number) prior to the stay and inform the owner of any visits. Under no circumstances may the rental be used by third parties (persons not registered on the contract) and therefore subletting is strictly forbidden, even free of charge, on pain of termination of the contract or even eviction; the full amount of the rent and deposit remains with or owed to the owner in the event of overcapacity or abusive subletting. Renters using OTA platforms are also required to provide full identity details. Only identified persons can benefit from the assistance-cancellation insurance.
- Art.7.3. Pets: Dogs are accepted in certain residences and in limited numbers (1 maximum per chalet, 2 for large chalets). Category 1 and 2 dogs, cats, rodents, vermin and NACs are prohibited. A fee will be charged for all pets. An additional deposit may be required. Please note that it is strictly forbidden to leave an animal alone in the residence in its absence, on pain of immediate expulsion and complete retention of the deposit; dogs are kept on a leash on the Cabane verte estate and any excrement is picked up by its owner.
Art.8. Security deposit : All tenants (also via OTAs) deposit a digital bank guarantee no later than the day of arrival and before entering the residence, via the secure Swikly system (the amount is neither blocked nor debited from your bank account); the tenant thus guarantees payment of expenses in the event of damage to the residence or rented equipment. Alternatively, the tenant can opt for a deposit on arrival during reception opening hours only, via “TPS” by bank pre-authorization (blocked amount not debited). Bank-guaranteed cheques are accepted. If not, the amount is deposited in cash.
The access code and/or chalet key will only be issued after authorization of the security deposit. The amount is released after inventory and final cleaning, or in any case is not pre-empted, also for any cash deposits. The tenant is no longer liable once the next tenant has checked in. If a cheque is deposited, it may be cancelled up to one month after the stay (no cheque is returned at the end of the stay) and destroyed (not returned by post). In the event of a problem (possibly in the presence of a bailiff or insurer), the deposit is first collected in full; it may then be partially or fully reimbursed, depending on the situation and the amount of the costs. In the event that the security deposit is insufficient to cover the costs, the tenant undertakes to make up the amount due. The amount withheld will be justified by the owner (report, estimate, bill of costs, invoices, etc.), who will forward any useful documents requested by the tenant’s insurer.
The deposit may cover any problem that may arise during the stay, except for those that are independent of the tenant’s fault. It also covers any rentals and purchases of equipment and products at the Domaine de la Cabane Verte. Renters who have contracted with an OTA are also required to pay a deposit, which may be retained until the OTA has settled any claims.
Art.9. Inventory of fixtures and fittings : The inventory of fixtures and fittings and the inventory of furniture and equipment are carried out at the beginning and end of the stay (during the final cleaning) by the owner or his representative. The tenant accepts that this inventory of fixtures is carried out by the latter. On arrival, the guest has 3 hours to check the inventory and report any discrepancies (by e-mail, SMS or to reception). After this time, the rented property will be considered to be perfectly clean, equipped and free of damage on arrival. During the stay, or at the latest on departure, the traveler must report any problem, damage or breakage. The owner will intervene as soon as possible after being informed of a problem. In the event of damage, the tenant will be contacted and informed within a week.
Art.10. Conditions for modifying and cancelling a stay Changes can be made up to 1 month before the holiday. Any refunds will be made by the insurance company (subject to its contractual conditions and provided the contract was taken out at the time of booking).
- Art. 10.1. Postponement of a stay : the dates of the stay can be changed up to 1 month before the stay. The postponement must be made within 12 months of the cancellation date and under the rental conditions applicable at the time of the new stay (any adapted CGL apply to this postponed contract), in a chalet of the tenant’s choice according to availability on the new date; the owner is not obliged to make the same chalet available. The rate applicable at the time of the new booking will be applied (with no refund in the event that the chosen date of stay is less expensive, the difference being charged as an administration fee). In the event of a second postponement, administrative charges may apply.
- Art. 10.2. Change of residence possible up to the day before your stay, subject to availability. The price of the new chalet will apply (with no refund if the chalet chosen is less expensive, the difference being charged as an administration fee). In the event of a second change, administrative charges may apply.
- Art. 10.3. Annulation d’un séjour : toute résiliation de réservation se fait par courriel ou par courrier postal recommandé avec accusé de réception, la date de réception faisant foi. En dehors des conditions mentionnées par ailleurs dans le présent document, aucun remboursement ni report n’est effectué, non plus dans les cas suivants : arrivée retardée, non présentation et départ anticipé quel qu’en soit la raison, diminution du nombre de participants, circonstances indépendantes de la volonté du propriétaire (météo, panne, émeute, épidémie, guerre, etc.).
- Cancellation by the tenant: the payment remains the property of the host, but may be reimbursed by the insurance company in accordance with its terms and conditions. The estate manager will provide the relevant documents, either to the tenant in the case of his insurance, or directly to “Campez couvert” in the case of insurance taken out or offered at the time of booking.
- Cancellation by the owner: in the event of cancellation by the owner before or during the contract period, the tenant is guaranteed an offer of one or more accommodations of equivalent or higher quality, or a full refund of the sums paid, or a pro rata refund of the price for a stay that has already begun. The owner cannot be held responsible for lack of availability of accommodation. If a replacement cannot be found, compensation may be granted in the form of a discount on a future stay.
- Art.10.4. If the tenant does not show up within 24 hours (no show) after the arrival date indicated on the reservation, his stay is cancelled and the owner may dispose of his rental as he sees fit; the total amount of the stay and related costs remain acquired and are due to the owner.
- Art. 10.5. Under no circumstances will the owner be liable for cancellations not covered by insurance.
Art.11. Insurance
- Art. 11.1. Rental insurance: the tenant is obliged to insure the rented property. He must check whether his main home insurance policy includes a holiday rental extension. If not, he must contact his insurance company and ask them to extend the coverage, or take out a special policy with a “vacation rental” clause. A certificate of insurance must be provided no later than the day of arrival. In the absence of such a certificate, the tenant declares on his honor the existence of insurance coverage, and in all cases will be held personally responsible and prosecuted for any damage caused by himself, by persons or pets occupying the property under his responsibility. The presentation of an insurance certificate is compulsory for the rental of the hall.
- Art. 11.2. Assistance, cancellation and refund insurance. The tenant is invited to take out appropriate insurance to cover individual risks. The “Campe Covered” insurance offered by the owner at the time of booking is 4% of the stay and covers only the rental part (excluding uninsured services). It covers the cost of modifying or cancelling a stay in a wide range of situations (serious illness, complications, accident, death of a relative, official summons, postponement of dates, late arrival, interruption of stay, replacement vehicle, repatriation including in the event of an epidemic or pandemic, cancellation costs in the event of COVID disease, contact cases, quarantine, etc.) according to the updated conditions of the insurance company. ) in accordance with Gritchen Affinity’ s current terms and conditions.
NB: renters who pay by credit card can use their bank’s travel insurance, which can cover some or all of these same risks (but only for people linked to their bank contract; this insurance does not cover friends and groups).
Art.12. Image rights The Domaine de la Cabane Verte may be photographed or videotaped during a stay. The use of these images is strictly limited to the promotion of the Domaine de la Cabane Verte. By subscribing to this contract, the tenant accepts the use of his image as well as that of the persons participating in his stay and under his responsibility. If the tenant does not wish his/her image to be used, he/she must inform us of this no later than the day of arrival (in writing to reception or by e-mail to management, who will confirm receipt of the request).
Art.13. Dispute : In general, any complaint must be sent as soon as possible by e-mail to direction@lacabaneverte.fr, who will intervene to encourage an amicable settlement of the dispute. All disputes arising from the non-performance of this contract shall be submitted to the exclusive jurisdiction of the courts of the département of residence.
In accordance with art. L612.1 of the French Consumer Code, free recourse is available to the MEDICYS mediation service(www.medicys.fr).
