CONDITIONS IN BRIEF :

GENERAL RENTAL CONDITIONS – COMPLETE

Art.1. Purpose : Seasonal rental contract drawn up between a tenant and the owner of the residence. In accordance with the French Tourism Code (art. L324-2), the description and price of the rental are communicated to the tenant. Only the information published on the website (except for errors in online pricing) and the booking form issued by the owner will be considered valid. Information published on other websites and networks, as well as photographs, are indicative only. The general terms and conditions of rental (hereinafter referred to as “GTC”) apply to all rentals, regardless of how the reservation is made.

Art.2. Tenant The “hirer” is the person who takes out the contract. The tenant is required to provide full contact details and the names of any accompanying persons for whom he/she assumes de facto responsibility. The owner undertakes not to divulge to any third party any information provided by the lessee in connection with this contract, with the exception of requests for information made by the authorities and/or the courts.

Art.3. Conclusion of contract : The reservation becomes effective when the tenant has paid the total amount of the stay after receiving the information and the invitation to pay. Payment therefore constitutes a contract and unreserved acceptance of the CGL as well as the complementary internal regulations (available on the website). In the absence of payment (unless specifically mentioned in the contract), the property remains available and the tenant cannot take advantage of the rental, which may therefore be cancelled and benefit a third party. In all cases, and as a matter of fair play, the tenant is required to inform the owner immediately if he/she wishes not to proceed or to cancel the booking request; otherwise, the owner is entitled to refuse the tenant for a subsequent stay.

Art 3.1. Contract duration and arrival and departure times : The lessee has entered into a contract for a fixed period; under no circumstances may he/she claim any right to remain in the premises after the expiry of the rental period initially stipulated in the contract, except with the written agreement of the owner and in advance payment of the amount of the authorized extension.

The tenant is expected on the first day of his stay between 4.00 pm and 6.00 pm / 7.00 pm (depending on the season) and leaves the residence on the last day of his stay by 10.00 am at the latest (12.00 pm for a one-night stay). Any delay in departure may be subject to a supplement of up to one additional night, unless otherwise agreed.

Art.4. Use of the premises : The owner will provide the premises or residence in accordance with the description, clean and in perfect working order. He will not undertake any work that is not of a manifestly urgent nature, except for the necessary seasonal maintenance of the surroundings.

Art.5. Terms of payment : all payments are made online on receipt of the contract. After a maximum of 24 hours, the stay may be transferred to a third party. In all cases, full payment must be made before you move in and will not be reimbursed by the owner (see insurance reimbursements).

Art.6. Tariff : Prices include VAT, compulsory services (linen and final cleaning) and all charges (water, electricity, pellets, wood, internet) within the limit of normal use (8 KW/day/person and no overrun of the internet package). Prices are available online and on request.

Art.7. Participants : The present contract is established for a specific accommodation of a certain capacity.

Art.8. Security deposit : All tenants (also via OTAs) deposit a digital bank guarantee no later than the day of arrival and before entering the residence, via the secure Swikly system (the amount is neither blocked nor debited from your bank account); the tenant thus guarantees payment of expenses in the event of damage to the residence or rented equipment. Alternatively, the tenant can opt for a deposit on arrival during reception opening hours only, via “TPS” by bank pre-authorization (blocked amount not debited). Bank-guaranteed cheques are accepted. If not, the amount is deposited in cash.

The access code and/or chalet key will only be issued after authorization of the security deposit. The amount is released after inventory and final cleaning, or in any case is not pre-empted, also for any cash deposits. The tenant is no longer liable once the next tenant has checked in. If a cheque is deposited, it may be cancelled up to one month after the stay (no cheque is returned at the end of the stay) and destroyed (not returned by post). In the event of a problem (possibly in the presence of a bailiff or insurer), the deposit is first collected in full; it may then be partially or fully reimbursed, depending on the situation and the amount of the costs. In the event that the security deposit is insufficient to cover the costs, the tenant undertakes to make up the amount due. The amount withheld will be justified by the owner (report, estimate, bill of costs, invoices, etc.), who will forward any useful documents requested by the tenant’s insurer.

The deposit may cover any problem that may arise during the stay, except for those that are independent of the tenant’s fault. It also covers any rentals and purchases of equipment and products at the Domaine de la Cabane Verte. Renters who have contracted with an OTA are also required to pay a deposit, which may be retained until the OTA has settled any claims.

Art.9. Inventory of fixtures and fittings : The inventory of fixtures and fittings and the inventory of furniture and equipment are carried out at the beginning and end of the stay (during the final cleaning) by the owner or his representative. The tenant accepts that this inventory of fixtures is carried out by the latter. On arrival, the guest has 3 hours to check the inventory and report any discrepancies (by e-mail, SMS or to reception). After this time, the rented property will be considered to be perfectly clean, equipped and free of damage on arrival. During the stay, or at the latest on departure, the traveler must report any problem, damage or breakage. The owner will intervene as soon as possible after being informed of a problem. In the event of damage, the tenant will be contacted and informed within a week.

Art.10. Conditions for modifying and cancelling a stay Changes can be made up to 1 month before the holiday. Any refunds will be made by the insurance company (subject to its contractual conditions and provided the contract was taken out at the time of booking).

Art.11. Insurance

NB: renters who pay by credit card can use their bank’s travel insurance, which can cover some or all of these same risks (but only for people linked to their bank contract; this insurance does not cover friends and groups).

Art.12. Image rights The Domaine de la Cabane Verte may be photographed or videotaped during a stay. The use of these images is strictly limited to the promotion of the Domaine de la Cabane Verte. By subscribing to this contract, the tenant accepts the use of his image as well as that of the persons participating in his stay and under his responsibility. If the tenant does not wish his/her image to be used, he/she must inform us of this no later than the day of arrival (in writing to reception or by e-mail to management, who will confirm receipt of the request).

Art.13. Dispute : In general, any complaint must be sent as soon as possible by e-mail to direction@lacabaneverte.fr, who will intervene to encourage an amicable settlement of the dispute. All disputes arising from the non-performance of this contract shall be submitted to the exclusive jurisdiction of the courts of the département of residence.

In accordance with art. L612.1 of the French Consumer Code, free recourse is available to the MEDICYS mediation service(www.medicys.fr).
